Remote texter can be held liable for distracted driver’s crash, appeals court rules

File this away in the “good to know” section of your brain…a New Jersey Appeals Court recently held that, “…a person sending text messages has a duty not to text someone who is driving if the texter knows, or has special reason to know, the recipient will view the text while driving…” Will this signal a trend in court opinions?   1. In a case of first impression, a New Jersey appeals court has held that a remote texter can be held liable to third parties for injuries caused when the distracted driver has an accident.
